Terms of Service

Welcome to MessageDesk (“Service”), owned and operated by Buzz Future Media (“we,” “our,” “us”). By accessing or using MessageDesk via our website, web application, or mobile app, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

1. Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use MessageDesk.
  • By using the Service, you represent that you have the legal capacity to enter into this agreement.
  • If you are using the Service on behalf of a business or organization, you represent that you are authorized to do so.

2. Account Registration

  • You must create an account to use certain features of MessageDesk.
  • You agree to provide accurate, complete, and current information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to notify us immediately of any unauthorized access to your account.

3. Acceptable Use Policy (AUP) 🚦

When using MessageDesk, you agree NOT to:

  • Use the service for spam, bulk unsolicited messages, or deceptive marketing.
  • Upload or transmit harmful code, malware, or viruses.
  • Engage in harassment, abuse, or illegal activities.
  • Infringe intellectual property or privacy rights of others.
  • Attempt to gain unauthorized access to our systems.

Violation of this AUP may result in account suspension or termination.

4. Payments & Billing

  • Certain features of MessageDesk may require payment (subscriptions, add-ons, usage-based billing, etc.).
  • Payments are processed securely via Razorpay, PayPal, and other payment processors.
  • You agree to provide accurate payment information and authorize us to charge your account.
  • All fees are non-refundable, unless required by law.
  • We may change pricing or subscription plans with prior notice.

5. Intellectual Property

  • All content, features, and functionality of MessageDesk (including software, code, design, trademarks, and logos) are the property of Buzz Future Media or its licensors.
  • You are granted a limited, non-exclusive, non-transferable license to use the Service.
  • You may not copy, modify, distribute, or exploit any part of the Service without our written consent.

6. User Content

  • You retain ownership of the content you create, upload, or transmit through MessageDesk.
  • By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to process, transmit, and store your content as necessary to provide the Service.
  • You are solely responsible for your content and must ensure it complies with applicable laws.

7. Third-Party Services

MessageDesk integrates with third-party services (e.g., AWS S3, Razorpay, PayPal, Resend, Tawk.to, Render, Netlify, Google Analytics, Microsoft Clarity).

  • Your use of third-party services is subject to their own terms and policies.
  • We are not liable for issues arising from third-party integrations.

8. Research & Benchmarking

We may use aggregated and anonymized user data (such as message metrics, engagement patterns, and communication insights) for research, analytics, and industry benchmarking. This data will never personally identify you.

9. Data Privacy

Our collection and use of personal data are governed by our Privacy Policy. By using the Service, you consent to our privacy practices.

10. Service Availability & Modifications

  • We strive to keep MessageDesk available at all times but do not guarantee uninterrupted service.
  • We may suspend, modify, or discontinue the Service (in whole or part) at any time without liability.

11. Disclaimers

  • MessageDesk is provided on an “as is” and “as available” basis.
  • We disclaim all warranties, express or implied, including merchantability, fitness for purpose, and non-infringement.
  • We do not guarantee that the Service will be error-free, secure, or meet your expectations.

12. Limitation of Liability

To the maximum extent permitted by law:

  • Buzz Future Media shall not be liable for indirect, incidental, special, or consequential damages, including loss of data, profits, or business opportunities.
  • Our total liability under these Terms shall not exceed the amount paid by you to use the Service in the last 12 months.

13. Indemnification

You agree to indemnify and hold harmless Buzz Future Media, its affiliates, employees, and partners from any claims, damages, liabilities, costs, or expenses arising from your:

  • Use of the Service
  • Violation of these Terms
  • Violation of applicable laws or third-party rights

14. Termination

  • You may stop using the Service at any time.
  • We may suspend or terminate your account if you violate these Terms, fail to pay, or misuse the Service.
  • Upon termination, your right to access MessageDesk will immediately end, but provisions related to intellectual property, liability, and indemnity will survive.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
